Agent sentenced later

A federal prosecutor is seeking an 84-month prison term for a Border Patrol agent who pleaded guilty to attempting to distribute methamphetamine and cocaine.

The sentencing for Noe Lopez, 37, of Chula Vista, was re-set April 5 to April 25 by U.S. District Court Judge Dana Sabraw in San Diego.

Lopez’s attorney, Robert Boyce, has argued in court documents for a sentence of no more than three years in federal prison. Lopez has been in the Metropolitan Correctional Center on $200,000 bail since his arrest on Dec. 14, 2016, in Imperial Beach.

Boyce filed documents that said Lopez’s illegal activities were limited to six weeks after he met a confidential informant at a party on Oct. 16, 2016 in San Ysidro. The informant recorded some conversations with Lopez and directed him to buy backpacks to conceal drugs.

Lopez met with the informant at a Chula Vista restaurant and discussed payment for Lopez picking up backpacks of drugs and delivering them elsewhere, according to the U.S. Attorney’s office. Lopez pleaded guilty to attempted distribution of drugs.
