Niece’s bail remains in the millions

Bail remains set at $2 million after a judge declined to reduce the bail May 15 for a driver who fled the U.S. Border Patrol and crashed her SUV in Chula Vista, killing her uncle.

Kyleigh Marsay Polite, 29, appeared before Chula Vista Superior Court Judge Theodore Weathers in a bid to lower her bail, but the judge left it at the amount it was set at her earlier arraignment.

Her uncle, Larry Dean Passmore, 54, was in the front passenger seat in the silver 2002 Acura on April 25 after she allegedly picked up three undocumented persons and drove at 85-100 mph on State Route 125. Polite lost control of the SUV, and it overturned, killing Passmore, of Sacramento.

Polite has been charged with murder in her uncle’s death. She has pleaded not guilty.
The three people she picked up were ejected from the vehicle as they were not wearing seat belts, said Deputy District Attorney Jerry Wendricks. They were hospitalized.
The vehicle skidded out of control, overturned, and rolled side over side several times near the Olympic Parkway exit in Chula Vista.

Earlier that day, Border Patrol personnel noticed three people get into the car off Alta Road in Otay Mesa. Agents tried to pull her over, but she refused to yield and got onto SR 125.

A preliminary hearing was set for July 22. Polite remains in the Las Colinas Women’s Detention Facility.
