Man’s mental state to be examined

A judge on Friday set a mental competency hearing for June 1 for a man in a wheelchair who produced a gun after allegedly shoplifting many items from a Chula Vista Kmart store.

The 12 charges are for now suspended against Mike Alan Hanby, 30, while he undergoes another psychiatric exam after his attorney said he was not mentally competent to stand trial. Hanby would be committed to a mental hospital if he’s not found competent.

The incident occurred Sept. 2, 2014, outside the Kmart store in the 800 block of East H Street when store employees followed Hanby outside after he left with a television and other electronic gear in a cart to his van. He did not pay for the items.

Hanby is alleged to have pulled a gun on four employees and burglary of the store with intent to commit theft. He drove his van with disabled plates onto Interstate 805 North and a Chula Vista Police officer attempted to pull him over.

He remains in the central jail without bail.
