Resisting executive comes with jail time

A Chula Vista man has been sentenced to 16 months in jail for resisting an executive officer following a 4-hour standoff that started with a domestic violence call.

Ruben Moreno Aguirre, 45, will be released from the George Bailey Detention Facility on Oct. 12, according to the sheriff’s department. Chula Vista Superior Court Judge Garry Haehnle sentenced him after Aguirre pleaded guilty to resisting an executive officer.

Chula Vista Police responded Feb. 11 to a call in the 200 block of East Oneida Street in which Aguirre’s girlfriend said she was battered and another man was injured. A prosecutor said Wednesday that charges involving injury to the girlfriend or the man were later not pursued due to lack of cooperation from witnesses.

A SWAT team released smoke inside the home, which caused Aguirre to come outside. He struggled with officers, spitting and fighting with them, while he was being handcuffed.

There was a child inside the home, and Aguirre was initially charged with child endangerment, assault, and vandalism, but those counts were dropped after the guilty plea to resisting an executive officer, a felony.
