Man with toys, clothes, gun convicted

A jury has convicted a man in a wheelchair of four counts of assault with a firearm and grand theft stemming from stealing a cartload of electronics from Kmart store in Chula Vista and pointing a gun at four employees.

Mike Alan Hanby, 30, acted as his own attorney and a jury convicted him of 12 charges after 2.5 hours of deliberations on Nov. 16, according to court records.

Sentencing was set for Dec. 16 by Chula Vista Superior Court Judge Garry Haehnle. Hanby could get at least five years in prison or more, depending on whether he is sentenced consecutively on the various counts.

Hanby was in a wheelchair and he filled up a shopping cart with two RCA televisions, an X-box, two toy robots, batteries, and clothing worth approximately $1,900 on Sept. 2, 2014 at 9 p.m. at the Kmart store at 875 East H Street, according to Deputy District Attorney Kristina Hein.

Hanby rode out of the store without paying and the store manager and three loss prevention personnel followed him to his van. Hanby displayed a revolver to all four employees and they backed away. The manager called Chula Vista police.

Hanby drove off in his van and went on Interstate 805. He entered San Diego and led San Diego police officers on a chase into downtown. A spike strip flattened one front tire and he ended up at police HQs on Broadway. He surrendered while surrounded by armed officers.

The jury also convicted him of evading police with reckless driving, carrying a loaded gun, concealing a gun in his vehicle, burglary, and carrying a concealed firearm. He had another gun in his vehicle and a knife under his wheelchair, according to court records.

He was found mentally competent to stand trial by another judge on June 19. He had six firearms that were registered to him. Hanby remains in jail without bail.
